YOU ARE INJURED OR HAVE A CLAIM AGAINST A CORPORATION THAT "GOES OUT OF BUSINESS" ?

In Illinois if a corporation is "involuntarily dissolved" for failing to file annual reports and/or its annual franchise fees, the officers and directors of the corporation may be individually responsible for a period of 5 years after the "involuntary dissolution"  for pending claims against the corporation at the time it is involuntarily dissolved.  Further - if the corporation continues to operate after being involuntarily dissolved the officers and directors of the corporation will be responsible individually for any debts or liabilities, including personal injury claims, for which the dissolved corporation becomes liable for during the period of time it continues to operate after being involuntarily dissolved by the Illinois Secretary of State.

Any questions ?  Call me ... I look forward to speaking with you.  Attorney George Sachs

NEW YEAR - SAME OLD ISSUES ! Why do you need a lawyer if you are injured ?

No matter how you are injured ... someone is either legally responsible OR afraid that they may be unfairly accused of being legally responsible for your injury, medical bills, lost income, pain, suffering and or disability.

To protect yourself and determine what you should do - contact an experienced personal injury attorney - as soon as possible - to help you decide how to proceed and what questions must be answered.

I am always happy to answer questions and to talk with you about your concerns.

Regards - Illinois Licensed Attorney George M. Sachs

In Illinois - If your employer or your employer's workers' compensation insurance company pays your medical bills what else should you know ?  You need a lawyer to help negotiate your claim for permanency.......

Workers' Compensation Claims - note - if Illinois law governs your workers' compensation claim - even if your employer's workers' compensation insurance company or administrator pays your medical bills - you are still entitled to seek a lump sum payment for "permanency" under the Illinois Act.

If you have any questions please call me George Sachs at 847-274-8312.

Kindest regards - George :)

Little Accident - Could Be A Big Problem !

You are driving in heavy slow traffic and you are hit from behind by another vehicle.  You get out - see no damage to the rear of your car and tell the other driver "to forget about it...".  Unfortunately your decision may end up having quite negative consequences for you.  Why?  If the other driver is not similarly inclined they may later report to either, or both, the police and their insurance company that you stopped suddenly and caused the collision and that THEY ARE INJURED !  Now you have a personal injury claim being brought against you and your insurance company and no documentation as to how or what happened.

If you are involved in a collision call the police and make a report immediately - make sure your version of what occurred is recorded for purposes of protecting you - even if you do not intend on bringing a claim against the other driver(s).  Secondly, always report any collisions to your insurance company even if you are not going to make a claim to prevent your insurance company from denying you coverage based on your alleged failure to have timely reported the collision to your insurance company.

Why Do I Need A Lawyer If I Am Injured In An Auto Accident ?

Assuming you are not at fault for the collision and there is a possibility that you may recover money for your medical bills, pain and suffering, disability, temporary and permanent injuries, etc.... the at fault driver's insurance company does NOT want you to have legal representation.  Frankly, the adjuster for the at fault driver's insurance company wants to sell you something - the emotional feeling - that you are going to be treated fairly and that you do not need your own lawyer to represent you.

Why?  Because the insurance companies and their adjusters know that if they can keep you away from a knowledgeable attorney that it will be much easier and cheaper for them to settle the claim than if someone with equal knowledge of the law and negotiation protocols is representing you - the injured party.

Alright, that is my "tip for the day."  Let me know if you have any questions on this topic or any injury or wrongful death related matters.

Have a good day!
